Chain of Title in Debt Sales
Chain of title for charged-off debt: assignment history, media, and why gaps cut price or kill a sale. Guide for sellers and qualified buyers.
Chain of title is the documented path of ownership from the original creditor to the current holder. In charged-off debt sales, it is often the difference between a competitive bid and a pass.
What buyers expect to see
- Bill of sale or assignment for each transfer
- Account-level schedule or data tape that matches the assignment
- Evidence of the original obligation where media is available
- Clear identification of the seller’s authority to convey
Gaps do not always make a pool unsaleable. They do change price, representations, and which buyers will engage. Sellers should disclose prior sales early rather than discovering them in diligence.
Seller checklist
Prepare a title binder before marketing: assignments, a sample of media, a list of accounts with missing documents, and any known disputes. That package shortens diligence and supports a 14–45 day close when the rest of the tape is complete.
